Petitioner is named in the first information report but when statement of victim was recorded under section 164 of the Cr.P.C, she stated only against co-accused Pramod Chauhan and two unknown persons.

Victim has, nowhere, stated name of the petitioner in her statement recorded under section 164 of the Cr.P.C. Petitioner and informant are co-villager.

Moreover, it is submitted on behalf of the petitioner that coaccused Pramod Chauhan has already been acquitted of the charge. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,
