The petitioner, Lala Paswan, seeks regular bail in East Colony P.S. Case No.48 of 2014, registered under Sections 25(1-B)a, 26(i)(ii) and 35 of the Arms Act.
The police, on secret information, intercepted a car and searched the occupants of the car. From the possession of one Shailesh Kumar, one loaded country made pistol of 9 MM and from the possession of the petitioner, Lala Paswan, one magazine and mobile phone were recovered.
Learned counsel for the petitioner submits that no independent witness put their signature on the seizure list. It appears that one magazine was recovered from the possession of the petitioner. Petitioner has got criminal antecedent as he is also accused in Parasbigha P.S. Case No.06 of
Patna High Court Cr.Misc. No.398 of 2015 (2) dt.08-01-2015 2/2 2013, registered under Sections 25(1-B)a and 35 of the Arms Act.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. Petitioner may renew his prayer for bail after remaining nine months in jail.
