The petitioner apprehends his arrest in Barh P.S. case No. 136 of 2019 registered under Section 30(a)/ 38/41 of the Bihar Prohibition & Excise Act.
The A.S.I. of Barh P.S. disclosed in his written report that he got secret inputs that Ram Jaipal Yadav, petitioner, Shravan Kumar and Munna Yadav, resident of village, Shekhopur were illegally selling liquor in their house. The informant on such information raided the house of Munna Yadav and recovered 150 pouches each containing 200 ml of country made liquor, 125 pouches and punching machine from the house of Munna Yadav.
The learned counsel for the petitioner submits that petitioner is not the owner of house and he is resident of another

Seizure list does not show from whose possession country made liquor was recovered but from perusal of the FIR it is clear that house of Munna Yadav was raided.
Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Barh P.S. case No. 136 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
