Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the state.
The petitioner seeks pre-arrest bail in connection with Derni P.S. Case No. 92 of 2020, registered under Sections 341, 323, 354, 354(b) and 506/34 of the Indian Penal Code. The accusation is that in the morning of 06.06.2020, the informant, Lagni Devi, moved from her house for morning walk. In the way Babloo Sah (petitioner) tried to outrage her modesty in that course he torn her blouse, then, the informant raised alarm on which Rudal Manjhi came there for her rescue, thereafter, Babloo Sah (petitioner) fled away from there. When the informant returned to her house, then, Chandan Sah and Mithlesh Sah, both brothers of Babloo Sah, came and threatened with dire consequences in case of informing the police about the incident.
Patna High Court CR. MISC. No.32198 of 2020(2) dt.05-03-2021 2/2 Submission is that in fact one day before the present occurrence, Ranju Kumari, sister of the informant, lodged Bheldi P.S. Case No. 95 of 2020 on 05.06.2020 for offence under Sections 341, 342, 323, 354(B), 504 and 34 of the Indian Penal Code and 3(1)(R) (W) and 3(2)(VA) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, against Vishal Kumar Singh and others, due to that reason Vishal Kumar Singh managed to lodge the present case through the wife of his labourer, Mrityunjay Manjhi. Further, submission is that the petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Derni P.
S. Case No. 92 of 2020 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, XII, Saran at Chapra, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
