JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-05-2015 Heard learned counsels for the petitioner and the State. The petitioners are languishing in jail since 10.07.2014 and 14.04.2014 in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code. It is alleged that the father of the informant was sleeping alone who has some fight with petitioner no.2 one day prior to the occurrence when the dead body of the father of the informant with cut injury on the chest and back was recovered. Near the dead body, piece of bangle, Ghunghru and handkerchief were recovered. Petitioner no.2 subsequently made confession before the police that she along with petitioner no.1 and one Basant Raut killed the father of the informant. The petitioners caused injury with knife when Basant Raut assaulted with leg.

No.15481 of 2015 (2) dt.14-05-2015 2/2 It is submitted by learned counsel for the petitioners that except confession of petitioner no.2 before the police, there is no tangible evidence collected by the investigating agency during investigation. The investigation has already concluded. Other coaccused Basant Raut has been granted bail vide Cr. Misc. No. 7751 of 2015. A statement has been made in para 3 of the petition that the petitioners has no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on bail, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Sikarhana at Motihari, East Champaran in connection with Patahi P.S. Case No. 29 of 2014.
