JUSTICE SATYAVRAT VERMA ORAL ORDER 12-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Bihariganj P.S. Case No. 33 of 2020, dated 03.02.2020 instituted for the offence under Section 395 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 03.08.2020 and charge-sheet has been submitted in this case.

Allegation is of looting of Rs.1500/-, mobile phone along with SIM and motorcycle by the petitioner and other named accused persons as disclosed by the villagers.

Learned counsel for the petitioner submits that petitioner because of his antecedent has been falsely implicated in the present case at the behest of the villagers as the informant was not knowing

Patna High Court CR. MISC. No.43349 of 2021(2) dt.12-01-2022 2/2 who had committed the occurrence. As such, based on the statement of villager, the informant instituted the FIR against this petitioner and others.

Learned counsel for the petitioner further submits that coaccused Dhruv Kumar Mandal @ Dhruv Mandal @ Uday Kumar has been granted bail by a Coordinate Bench of this Court vide order dated 28.06.2021 passed in Cr. Misc. No. 12223 of 2021 (Annexure2). Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that petitioner is a veteran criminal and has antecedent of twelve cases. Considering the fact that the petitioner is in custody, charge-sheet has been submitted and co-accused has been granted bail let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No. 33 of 2020.
