Singh, learned senior counsel for the petitioner, Ms. Rina Kumari, learned counsel for the Informant and learned Additional Public Prosecutor for the State through video conferencing.

Petitioner seeks regular bail in connection with Parsauni PS Case No. 42/2020 registered for the offence punishable under Sections 363/366A of the IPC. As per First Information Report, the petitioner abducted the daughter of the informant with the help of other co-accused persons.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has not committed any offence in the manner alleged. He further submits that the victim girl was having love affair with one

No.42796 of 2021(2) dt.03-02-2022 2/3 Sunil Ram and she was recovered from the possession/custody of Sunil Ram by the police and in her statement recorded under Section 164 CrPC, she has disclosed her aged as 20 years and she has also disclosed that she was in love with Sunil Ram. Learned counsel further submits that the only allegation against the petitioner is that he along with co-accused persons abducted the victim girl and handed over to her lover, Sunil Ram. He next submits that similarly situated co-accused person namely, Dilip Kumar Chaudhary @ Dilip Chaudhary has been granted anticipatory bail by a Co-ordinate Bench of this Court vide Cr. Misc No. 8593/2021 and the petitioner is in jail since 22.06.2021 having no criminal antecedent. The chargesheet has already been submitted and the matter, has now, been compromised between the parties.

On the other hand, learned counsel for the informant submits that she has got no objection if the petitioner is granted bail by this Court inasmuch as both the parties have arrived at the compromise and the informant has solemnized marriage of the victim girl.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated co-accused person has been

No.42796 of 2021(2) dt.03-02-2022 3/3 granted anticipatory bail by a Co-ordinate Bench of this Court, petitioner is in custody since 22.06.2021 having no criminal antecedent, charge-sheet has been submitted and there is no likelihood that petitioner will abscond or will tamper with the evidences, if released on bail, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, BAGISH KUMAR @ BAGISH RANJAN @ BAGISH KUMAR RANJAN be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, VI, Sitamarhi/the concerned court in connection with Parsauni PS Case No. 42/2020.
