The petitioner seeks bail in connection with Gandhi Maidan P.S. Case No. 504 of 2015 registered for the offences punishable under Sections 420, 489, 489(A), 489(B) and 489(C)/34 of the Indian Penal Code.

Allegedly, the petitioner was caught with fifty seven fake currency notes each of 1,000/- denomination besides other articles when he was trying to purchase mobile. Submission is of false implication and that no offence under Sections 420, 489(A) and 489(B) IPC is made out and it is hardly a case under Section 489(C) IPC which is bailable in

Patna High Court Cr.Misc. No.6053 of 2016 (2) dt.23-02-2016 2/2 nature, petitioner is a student of Arraria College and he was handed over the said notes by his friend Raja for purchasing a mobile and, as such, the petitioner who is suffering in custody since 08.12.2015, deserves sympathetic consideration. The learned A.P.P. opposes the prayer of bail. In the facts and circumstances stated above, considering the detention of the petitioner, now he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Patna in connection with Gandhi Maidan P.S. Case No. 504 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
