JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Korha P.S. Case No. 72 of 2014 registered for the offences punishable under sections 25(1-B)a and 26 of the Arms Act.

It has been contended that according to the prosecution case, the petitioner was apprehended by the villagers, who handed him over to the police. In that case, in view of section 37 of the Arms Act, 1959, the offence would be bailable in nature. The petitioner is reported to be in custody since 6th May, 2014. Learned counsel for the State has opposed the prayer for bail.

Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail

Patna High Court Cr.Misc. No.51634 of 2014 (3) dt.03-03-2015 2/2 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No.72 of 2014.
