JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 01.11.2014 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The accusation is of robbing the truck and mobile of the driver and cleaner of the truck.

It is submitted by learned counsel for the petitioner that the name of the petitioner sprang up during investigation on the confession of co-accused. A statement has been made in para 8 and 10 of the petition that neither any recovery has been made from the possession of the petitioner nor the petitioner has been put on TI parade.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/-

Patna High Court Cr.Misc. No.14924 of 2015 (2) dt.05-05-2015 2/2 (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Runnisaidpur P.S. Case No. 179 of 2013.

Since the petitioner is accused in five other cases, learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
