JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner. Seen the report submitted by the learned lower court wherefrom it is evident that after closure of the prosecution case, 15.10.2016 has been fixed for statement of the accused. That being so, now the ball has gone to the court of accused that means to say it is on the accused to have disposal of the trial according to his own choice. If co-operated at the end of petitioner, then in that event, the learned lower court will decide the same at an earliest.
With regard to reconsideration of the bail is concerned, in the aforesaid facts and circumstances of the case, I do not find any cogent reason to reconsider particularly in the aforesaid background and that being so, prayer for bail of the petitioner is rejected.
