2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 126(2), 74/76 of the Bharatiya Nyaya Sanhita, 2023 and sections 8/12 of the POCSO Act.

3. As per the prosecution case, when 12 years old daughter of informant went to attend coaching, this petitioner touched her inappropriately and tried to outrage modesty. Petitioner agreed not to repeat the offence in future before Panch but on 16.11.2024 he again teased the victim with bad intention.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been

Petitioner is a private teacher and there is no such allegation from any other student and when victim was removed from the coaching due to non-payment of fee, informant implicated the petitioner in the present case with concocted allegations. Petitioner claims clean antecedent. He is in custody since 7.3.2025.

5. Learned counsel for the State opposes the prayer for bail. He submits that there is direct allegation that petitioner repeatedly tried to outrage modesty of 12 years daughter of the informant. He submits that the victim, in her statement recorded under section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has supported the case.

6. Considering the nature and gravity of allegation and victim's aforesaid statement, prayer for bail of the petitioner is rejected.
