The petitioner seeks bail in connection with Forbesganj (Simraha) P.S. Case No. 170 of 2019 initially registered for the offences punishable under Section 341, 342, 325, 307 and 504/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added. It is submitted by the learned counsel for the petitioner that the informant has made specific allegation in the first information report against four accused persons, namely, Matra Rishideo, Suraj Rishideo, Bablu Rishideo and Kripanand Rishideo. The petitioner is not named in the first information report. The name of the petitioner has been given by the
2/3 co-accused Matra Rishideo @ Ravi Kumar, who has already been granted bail by a Bench of this Court vide order dated 24.10.2019 passed in Cr. Misc. No. 43378 of 2019. The case of the petitioner stands on better footing than that of Matra Rishideo @ Ravi Kumar.
Learned counsel for the State has opposed the application for grant of bail to the petitioner. However, he concedes that the case of the petitioner stands on better footing than that of co-accused Matra Rishideo @ Ravi Kumar. Considering the allegations made in the first information report, the submissions advanced at the Bar and the statement made in paragraph-3 of the application that the petitioner has got no criminal antecedent, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No. 170 of 2019.
Since the court proceedings are being conducted through virtual mode and normal court functioning has not been restored till date, it is considered appropriate to adopt the following procedure for communication of the present order:-
3/3 (i) The order, which has been dictated during the course of proceeding of the virtual court, shall be communicated to me on my e-mail by the Sr.
Secretary.
(ii) The corrected copy of the order shall be transmitted by me from my e-mail id to the Sr. Secretary, which shall be treated to be an authentic copy of the order passed by this Court in the present proceeding. (iii) Hard copy of the order duly signed by me shall be preserved in my residential office for documentation and future use, if any.
(iv) Let steps be taken by the Sr. Secretary/registry for up-loading of the present order without compromising with the norms of social distancing.
