The petitioners seek regular bail in a case registered under Sections 302/34 of the Indian Penal Code. The informant lodged Udwant Nagar P.S. Case No. 158/12 against unknown after recovery of the dead body of his brother and uncle. The police, after investigation, submitted final form as clueless. The informant thereafter filed protest petition and suspected the hands of the petitioners and others in killing of his brother and uncle. The case proceeded on complaint. The petitioners were granted anticipatory bail vide order passed in Cr. Misc. No. 54444/2013 but the complainant preferred Cr. Appeal No. 2617/2014, arising out of SLP (Crl.) No. 5064/2014. The
Patna High Court Cr.Misc. No.11272 of 2015 (2) dt.18-03-2015 2/2 Hon'ble Supreme Court set aside the order dated 20.03.2014 passed in Cr. Misc. No. 54444/2013 with a direction to the petitioners to surrender in the court below. In pursuance thereof, the petitioners surrendered in the court below and prayed for regular bail.
It appears that except suspicion there is no tangible material against the petitioners. Other co-accused persons, namely, Hare Ram Singh, Bali Ram Singh and others have been granted regular bail vide order passed in Cr. Misc. No. 6118/2015 and Cr. Misc. No. 9383/2015.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge, Ara, Bhojpur in S. Tr. No. 263/14, arising out of Protest Complaint No. 260 (C)/2013.
