Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks pre-arrest bail in connection with Madanpur P.S. Case No. 103 of 2020 registered under Sections 8(b), 20(a), 20(b), 2(c ) of N.D.P.S. Act.

Accusation is that in course of petrolling duty, informant and other police personnel reached in village Khutidih near the house of petitioner (Amin Ram) and on verification, 95 ganja plants were found in the field behind the

Patna High Court CR. MISC. No.32101 of 2020(2) dt.20-02-2021 2/2 house of the petitioner and green leaves of ganja plants in two boxes were seized for chemical examination.

Submission is that it would appear from first information report that seized ganja leaves were not recovered from the field of the petitioner rather the same was said to be recovered behind the house of the petitioner which is common use land of the villagers. Thereafter, behind the house of Jaigovind five ganja trees were found which were also seized. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/ arrest, within a period of four weeks from today, in connection with Madanpur P.S. Case No. 103 of 2020 be released on bail on furnishing bail bonds of Rs 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the A.D.J I-cum- Special Judge, Aurangabad or the Successor Court subject to the condition as laid down under section 438(2) Criminal Procedure Code.
