The petitioner, Santosh Kumar, seeks regular bail in Nathnagar P.S. Case No.202 of 2014, registered under Sections 457 and 380 of the Indian Penal Code.

The informant lodged the case against unknown for theft in the house of Ganesh Chandra Chatterjee. It appears that petitioner is not named in the first information report. During course of investigation, petitioner was apprehended and he is said to have given his confessional statement. One Ramu Yadav was also apprehended and from his possession one mobile is said to have been recovered. Except that there is no material to show the involvement of the petitioner in the alleged crime of theft. Petitioner is in jail since 29.08.2014 and he has got no criminal antecedent.

No.670 of 2015 (2) dt.09-01-2015 2/2 Considering the facts aforesaid, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar P.S. Case No.202 of 2014.
