The petitioner seeks regular bail in a case registered under Sections 498A/304B/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
The prosecution case is that Sweety Kumari was married to Indrajeet Dubey in the year 2001 but thereafter all the accused persons burnt her to death.
Learned counsel for the petitioner submits that the petitioner is not at all directly related with the husband of the deceased. The petitioner is a resident of another Village - Harail, falling in the district of Samastipur. Co-accused Santosh Tiwary has already been granted bail vide order dated 16.12.2014 passed by a Bench of this Court in Cr. Misc. No. 47954 of 2014. The mother-in-law of the deceased has also been granted bail by the
Patna High Court Cr.Misc. No.3128 of 2015 (2) dt.22-01-2015 2/2 learned Sessions Judge.
Considering the facts aforesaid and the fact that the petitioner is only a relative of the husband of the deceased and there is no specific allegation against him, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Vaishali in Goraul P.S. Case No. 37 of 2005.
