JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 21-07-2026 At the outset, after short argument, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail of petitioner no.1, namely, Laxman Manjhi @ Lakshman Manjhi.
2. In view of aforesaid, the anticipatory bail petition of petitioner no. 1 stands dismissed as withdrawn.
3. Now, present petition only survives against the petitioner no. 2, namely, Ramji Manjhi.
4. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

5. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Karpi P.S. Case No.35 of 2026 registered under Sections 191(2), 190, 115(2), 117(2), 121(1), 121(2), 109, 125(b) and 132 of the Bharatiya Nyaya Sanhita, 2023 (in short 'BNS').
6. The allegation against the petitioner is to enter into scuffle with police person/informant who raided the house of the petitioner under information that the petitioner indulges in illicit liquor business/trade.

It is submitted by learned counsel for the petitioner that petitioner no. 2 was implicated with present crime in question only for the reason that he is the brother of co-accused, Laxman Manjhi @ Lakshman Manjhi, for whom the police raided his house. It is submitted that the co-accused Laxman Manjhi @ Lakshman Manjhi, was accused in two more excise cases and when under secret information, informant/ police team conducted the raid to his house, co-accused Laxman Manjhi @ Lakshman Manjhi with unknown co-villagers started pelting stones and brick plate upon informant and police personnel during which the
3/4 informant received injury below his eye. It is submitted that the allegation of assault and also of pelting stones and further to deter police official from discharging their official duty is very much general and omnibus against this petitioner. Petitioner claimed clean antecedent.
8. Learned APP opposed the prayer of bail.

In view of aforesaid factual submissions and by taking note of fact as petitioner no. 2, namely, Ramji Manjhi not found involved in any excise case coupled with the fact that the allegation qua pelting stones or to deter informant/police from discharging their official duty prima facie appearing very general and omnibus against the petitioner, accordingly, the petitioner no. 2, namely, Ramji Manjhi, who is a man of clean antecedent, is directed to be released on bail, in the event of his arrest or surrender in the court below within a period of four weeks, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal, in connection with Karpi P.S. Case No.35 of 2026, subject to the conditions as
4/4 laid down under Section 438(2) of the CrPC/under Section 482(2) of the BNSS.
