The petitioner seeks bail in Sabour P.S. Case No. 13 of 2021, registered for the offence punishable under Sections 276, 420 and 34 of the Indian Penal Code, sections 8(C), 18(C), 26(a), 27(b)(ii), 28 of the Drugs and Cosmetics Act and section 20/22 of the NDPS Act.

As per the prosecution case, on secret information a raid was conducted, two cartoons were recovered from the house of this petitioner. One cartoon containing 18 bottles of Codeine Phosphate and Chlorphenirmaine Maleate Syrup (cough Lincuts) each 100 ml and 8 packets of injection water and no valid documents was produced by the petitioner when demanded.

Patna High Court CR. MISC. No.45494 of 2021(2) dt.15-11-2021 2/2 has been recovered from conscious possession of this petitioner. Recovery has been made from the house which is in joint possession of the family. Petitioner is in custody since 10.01.2021 having clean antecedent. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhagalpur in connection with Sabour P.S. Case No. 13 of 2021.
