====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-02-2016 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. representing the State.
The petitioner seeks bail in connection with Majhauliya P.S. Case No. 518 of 2015 registered for the offence punishable under Section 420 of the Indian Penal Code. Allegedly, in the name of lottery, an amount of Rs. 15,000/- was got deposited in the account no. 0780000100239415 and thereafter, Rs. 5,000/- was withdrawn and when again the petitioner went with one Mintu to withdraw the amount, he was caught.
Submission is of false implication and that the petitioner is the student of B.A. having no criminal antecedent, the

No.6016 of 2016 (2) dt.23-02-2016 2/2 petitioner is ready to return back the amount of Rs. 15,000/- to the victim in her account, the petitioner suffering in custody since 05.12.2015, deserves sympathetic consideration. The learned APP duly assisted by the learned counsel for the informant, in changed circumstances does not oppose the prayer of bail.
In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran, Bettiah in connection with Majhaulia P.S. Case No. 518 of 2015 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail, and that the petitioner shall deposit the amount of Rs. 15,000/- either through bank draft or in the account of victim, Meera within three months, failing which the bail granted to the petitioner shall stand cancelled.
