Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Kasma P.S. Case No. 28 of 2021 for the offence punishable under Sections 147, 149, 323, 504, 506, 307 and 436 of the Indian Penal Code.
Learned counsel for the petitioners seeks
Patna High Court CR. MISC. No.44635 of 2021(3) dt.20-04-2022 2/2 permission to withdraw this bail application on behalf of petitioner no.1, above named, who has been arrested by the police.
Accordingly, this bail application is dismissed as withdrawn as against petitioner no.1, above named. So far as the bail of petitioner nos. 2 to 9 is concerned, the same is allowed considering fact that there is case and counter case from both the sides and both the sides have sustained injuries, inasmuch as, some persons from other side have been granted anticipatory bail by a coordinate Bench of this Court.
Accordingly, let the petitioner nos. 2 to 9, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Kasma P.S. Case No. 28 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sandeep Kumar, J) pawan/- U T
