The petitioner seeks regular bail in Makhdumpur P.S. Case No. 230 of 2014 registered under Section 376 and other sections of the Indian Penal Code.

The informant alleged that Manoj Kumar Gupta had taken a loan from the informant and when she demanded money, Manoj Kumar Gupta took her to his house on the pretext of returning the money. She further alleged that Manoj Kumar Gupta made an attempt to commit rape with her.

Learned counsel for the petitioner submits that the dispute arose on account of returning of borrowed money and no occurrence, as alleged by the informant, has ever taken place. The petitioner has got no criminal antecedent and he is in jail for more than three months.
