JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-07-2019 This is an application for grant of anticipatory bail in connection with Gurua P.S. Case No. 158 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 337, 448, 307, 379, 504, 506 & 302 of IPC.

Allegation against the petitioners and other accused persons altogether eleven in number of assaulting the decease as well as other persons, causing injuries and later on, deceased succumbed injuries and due to that, he died.

Submission of the learned counsel for the petitioners is that though the allegation of assault against the petitioners and other accused persons, petitioner no.1 is lady and petitioner no.2 is aged about 75 years.

Having heard both sides, considering the fact that petitioner no.1 is lady and also considering the age of petitioner no.2, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned S.D.J.M., Gaya, in connection with Gurua P.S. Case No. 158 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
