JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 447, 341, 379, 387 and 406/34 of the Indian Penal Code.

It is alleged that the informant executed a power of attorney with respect to the land for sale bearing Katha No. 9, Plot No. 885, area 26 decimals at the rate of `2,10,000/- per katha in favour of co-accused Rajiv Nayan who gave `1,70,000/- to the informant and promised to pay rest of the amount after sale of the land in question but the balance amount was not given. It is alleged against the petitioner that he is identifier of the sale deed. It is submitted by learned counsel for the petitioner that even assuming the accusation, no offence is made out against the petitioner.

No.1226 of 2015 (2) dt.13-01-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Bodh Gaya P.S. Case No. 203 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
