This application for anticipatory bail arises out of Case No. B-III-32 of 2011, disclosing the offence under Sections 16(1) (A) of the Prevention of Food and Adulteration Act.

It is stated by learned Senior Counsel, appearing on behalf of the petitioner, that on the basis of a raid conducted on 01.12.2010 in a hotel run by the petitioner, five separate criminal cases were registered. The petitioner, however, was in the know of only four cases, whereafter he had taken steps for grant of anticipatory bail, and this Court by various orders, copies of which have been produced by the learned Senior Counsel for the petitioner, were allowed anticipatory bail. Mainly because the petitioner was not knowing about the present case and he learnt about this case recently, this application for grant of anticipatory bail has been filed, now,

There is allegation of use of substandard materials in preparation of Laddoos.

Considering the fact that in other cases the petitioner has been allowed anticipatory bail, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Case No. B-III-32 of 2011, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
