JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 Heard learned counsels for the petitioners and the State. The petitioners being father and brothers of the husband of the victim are languishing in custody since 26.8.2014 in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant by causing burn injury for non fulfillment of dowry demands.
It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general when the marriage was performed 12-13 years prior to the occurrence. Petitioner no. 3 is about 85 years of age and other family members of the victim have been granted anticipatory bail by this court vide Cr. Misc.
Patna High Court Cr.Misc. No.129 of 2015 (2) dt.07-01-2015 2/2 No. 16839 of 2014.
Considering the general and omnibus nature of accusation, relationship of the petitioners with the victim and the submission of learned counsel for the petitioners that the husband of the victim is in custody, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Danapur in connection with Maner P.S. Case No. 473 of 2013.
