The petitioner seeks bail in Mahua P.S. Case No.414 of 2020 registered under Sections 399 and 402 of the Indian Penal Code.

The informant alleged that mobiles of the petitioner and others were put on surveillance and on the basis of conversation, a raid was conducted. The petitioner was arrested but his accomplices managed to flee away.

The learned counsel for the petitioner submits that petitioner was arrested on the spot and since 24.07.2020, petitioner is in jail. No incriminating article such as firearm was recovered from the possession of the petitioner. Petitioner has already remained in jail for more than four months. Taking into consideration the facts aforesaid and
