The petitioners are languishing in custody since 27.01.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 324, 325, 326, 307, 436, 380, 427, 302, 153A, 295A and 363 of the Indian Penal Code. It is alleged that on information being received about half buried dead body of one Bhartendu Kumar near the mosque, raid was laid, but by then the mob put several houses on fire. Subsequently, arson was controlled and the dead body was sent for post-mortem.
Patna High Court Cr.Misc. No.14052 of 2015 (02) dt.27-04-2015 2/2 It is submitted by learned counsel for the petitioners that the FIR has been lodged against 17 named persons and 1000 unknown. The petitioners are not named in the FIR wherein the accusation is specific. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent and investigation has already concluded. Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, West Muzaffarpur in connection with Saraiya P.S. Case No. 20 of 2015.
