The petitioner seeks bail in Special Case No. 10/2018, arising out of Sadar P.S. Case No. 384/2018, instituted for offence under Section(s) 20 and 22 of NDPS Act. It is alleged in the written report that on getting secret information police raided the betel shop of petitioner and Makkhan Choudhary. Seeing the police party they managed to escape. In presence of witnesses shop of accused persons was searched, from where 27 small packets of Ganja was recovered and 9.600kg Ganja was recovered from the joint house of this petitioner and Makkhan Choudhary.

Patna High Court CR. MISC. No.33618 of 2019(3) dt.18-07-2019 2/2 Learned counsel for the petitioner has submitted that nothing has been recovered from conscious possession of this petitioner. Seizure-list does not bear signature of any of accused persons.

Petitioner is in custody since 16.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Purnea, in connection with Special Case No. 10/2018, arising out of Sadar P.S. Case No. 384/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
