The petitioner seeks bail in Siwan Muffasil P.S. Case No.286 of 2020, registered under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

The police intercepted two vehicles and recovered 129.6 litres and 60 litres of liquor from both the vehicles. The petitioner was the driver of a Wagon-R, bearing Registration No. BR-1AH-8857 and from the vehicle of the petitioner, 129.6 litres of liquor was recovered.

Learned counsel for the petitioner submits that the petitioner is in jail since 22.06.2020. The petitioner has already remained in jail for more than six months for recovery of 129.6 litres of liquor and he has got no criminal antecedent.

No.32313 of 2020(3) dt.04-01-2021 2/2 Taking into consideration the facts that the petitioner has already remained in jail for more than six months and he has got no criminal antecedent, petitioner, namely, Rajesh Kumar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Siwan in connection with Siwan Muffasil P.S. Case No.286 of 2020.
