JUSTICE PRABHAT KUMAR JHA ORAL ORDER 07-12-2020 Heard Mr. Pravin Kumar, the learned counsel for the petitioner and Mr. Braj Kishore Prasad, the learned Additional P.P. through video conferencing.

The petitioner seeks bail in Muffasil P.S. Case No.201 of 2019, registered under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code and under Sections 3⁄4 of the Dowry Prohibition Act.

The petitioner is the husband of the informant. The informant alleged that immediately after her marriage with the petitioner, the petitioner and his family members started torturing the informant. They made an attempt to burn her but when they failed, the petitioner and others tried to slit her neck but they could not succeed as on alarm many persons came and

Learned counsel for the petitioner submits that no injury, caused by any sharp edged weapon, was found on the body of the informant. The petitioner being the husband of the informant is in jail since 18.01.2020. The petitioner has already remained in jail for about 11 months.

Taking into consideration the facts and nature of allegations made against the petitioner and the fact that the petitioner is in jail for about 11 months, petitioner, namely, Munna Giri is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Muffasil P.S. Case No.201 of 2019.
