2. The accused/petitioner is not named in the FIR and apprehending his arrest in connection with Athmalgola P.S. Case No.237 of 2024 registered under Sections 80(2), 238, 3(5) of the Bhartiya Nyaya Sanhita, 2023 (in short 'B.N.S.').

3. As per FIR, the daughter of informant was killed by her husband and in-laws due to non-fulfilment of demand of dowry and disposed her body for destroying the evidence.

4. It is submitted by learned counsel appearing for petitioner that petitioner is neither family members nor relative of the husband of deceased. It is submitted that

No.33282 of 2025(2) dt.21-05-2025 2/3 merely being the co-villager, upon request of the family members of the husband of deceased, as petitioner participated in last rites, therefore, he was implicated with present case. It is submitted that maximum allegation, which attracts against the petitioner is to help in destroying the evidence under Section 201 of the IPC/238 of the BNS. The petitioner is said to be a man of clean antecedent.

5. Learned APP opposed the prayer for anticipatory bail of the petitioner.

Considering the nature of accusation, as the petitioner is not related in any manner with the family of the husband of deceased daughter of the informant, where maximum allegation prima facie appears against petitioner to attend last rites of the deceased and help thereof, accordingly, the petitioner, above-named, in the event of his arrest or surrender in the court below within a period of four weeks from today, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Barh, Patna in connection with
