1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the opposite party no. 2.

2. Learned counsel for the petitioner submits that the present case was marked to the learned counsel by the Legal Aid Committee of the Patna High Court. It is further submitted that the instant application has been filed seeking cancellation of the anticipatory bail granted to the opposite party no. 2.

3. At this stage, learned counsel for the opposite party no. 2 submits that the trial is on verge of conclusion, out of four prosecution witnesses three witnesses have been examined and only the investigating officer of the case remains to be examined.

4. The said submission of the learned counsel for the opposite party no. 2 is not disputed by the learned counsel appearing on behalf of the petitioner.

5. The Court directs the Senior Superintendent of Police, Patna to ensure that the investigating officer of the case remains present in the trial on the next date fixed.

6. Since the trial is on verge of conclusion, as such, the Court is not inclined to entertain the present cancellation application. The present cancellation application is thus rejected with the aforesaid direction.
