The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, one country made pistol with two loaded cartridges and a mobile phone were recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. He is in custody since 8.12.2020 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.44429 of 2021(2) dt.24-01-2022 2/2 taking into consideration the petitioner being in custody for 1 year and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Pirbahor P.S. Case no. 477 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna.
