The petitioners seek bail in a case under Section 302 and other sections of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is that some quarrelling took place and, on such, Kamlesh Yadav is said to have fired causing injury to the son of the informant and the son of the informant died. It is submitted that there is no allegation of firing against the petitioners, namely, Minku @ Alok Bharti and Anwesh Yadav. Similarly situated co-accused Sarun Yadav @ Sarun Prasad Yadav and Bibhuti Yadav have already been enlarged on bail vide orders passed in Cr. Misc. 1654/2015 and Cr. Misc. No. 3212/2015.

Patna High Court Cr.Misc. No.9394 of 2015 (3) dt.01-04-2015 2/2 Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in Falka (Pothia) P.S. Case No. 251/2014, corresponding to G.R. No. 3020/14.
