The petitioner seeks bail in connection with Baheri P.S. Case No.54 of 2024 registered for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is to have committed murder of the brother of the informant along with other co-accused persons.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been

No.36646 of 2024(4) dt.27-09-2024 2/2 implicated in the present case, where petitions are not named in the FIR and their name surfaced on the basis of confessional statement of other co-accused person, namely, Sidharth Jaiswal @ Golu Chaudhary, who has already been granted bail by this Court vide Cr. Misc. No.38731 of 2024 on 01.08.2024. It is submitted that nothing has been surfaced during course of investigation against these petitioners which may connect them with the present set of occurrence. It is further submitted that petitioners are man of clean antecedent and they are in custody since 02.03.2024.

Learned APP appearing for the State, opposes the prayer for bail of the petitioners. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioners, let these petitioners, above named, are directed to be released on bail, in connection with Baheri P.S. Case No.54 of 2024 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Darbhanga.
