JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 11.08.2014 in a case registered for the offences punishable under Sections 307, 302, 34, 120B of the Indian Penal Code and 27 of the Arms Act. Petitioner is not named in the first information report. The informant claims to have seen the alleged occurrence and stated about the specific role played by the first information report named accused persons. The name of petitioner came in this case in confessional statement of co-accused, Sanjeet Kumar Bind in course of investigation and thereafter, petitioner also confessed his guilt. Except the aforesaid facts as well as materials, there appears to be nothing against the petitioner.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.52149 of 2014 (2) dt.07-01-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 348 of 2014.
