JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)A, 26 of the Arms Act. One country made loaded pistol and one live cartridge are said to have been recovered from conscious possession of the petitioner for which petitioner is in jail custody since 31.08.2015. No doubt, petitioner carries criminal antecedent of near about five cases but in the present case, petitioner has sufficiently been punished by remaining in jail custody for near about seven months.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.12259 of 2016 (2) dt.29-03-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Dalasing Sarai, Samastipur in connection with Dalasing Sarai P.S.
