Petitioner seeks bail in Khizersarai P.S. Case No.321 of 2019 registered under Sections 366(A) and 34 of the IPC. The informant alleged that his daughter had gone to the field but Ravi Bhushan Kumar kidnapped his daughter with the help of Mahesh Kumar and Anil Kumar (petitioner). Learned counsel for the petitioner submits that the victim made her statement under Section 164 of the Cr.P.C. She disclosed her age to be 16 years. She also disclosed that the petitioner and Ravi Bhushan kidnapped her. Anil Kumar (petitioner) left her near Rajgir Railway Station. Thereafter Ravi Bhushan took her to another place by a train. After having come to know about the institution of the case, Ravi Bhushan left her at Gaya Railway Station. It is submitted that co-accused Ravi

Patna High Court CR. MISC. No.32349 of 2020(5) dt.04-01-2021 2/2 Bhushan Kumar has already been enlarged on bail vide order passed in Cr.Misc.No.28779 of 2020. The case of the petitioner stands on better footing. The victim was having love affairs with Ravi Bhushan Kumar.

Taking into consideration the facts aforesaid and the fact that co-accused Ravi Bhushan Kumar has already been enlarged on bail, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M. 4th, Gaya in connection with Khizersarai P.S. Case No.321 of 2019.
