2. It appears to this Court that on 26.09.2022 number of Criminal Miscellaneous has wrongly been typed as Criminal Miscellaneous No. 42557 of 2021 in place of Criminal Miscellaneous No.53557 of 2021. In result, the order passed in Criminal Miscellaneous No.43557 of 2021 could not be uploaded on the website with correct Criminal Miscellaneous. As such, the said order which has wrongly been typed in this case being Criminal Miscellaneous No.42557 of 2021 is hereby recalled and it is directed that the said order shall be typed in Criminal Miscellaneous No.43557 of 2021 and it shall be uploaded on the website which reads as under:-

Patna High Court CR. MISC. No.43557 of 2021(14) dt.22-02-2024 2/3 "Let the defect(s), if any, be removed within two weeks from today.

Heard learned counsel for the petitioner and learned A.P.P. for the State and learned counsel for J.C. to S.C. 11. The petitioner seeks regular bail in connection with Rajnagar P.S. Case No. 79 of 2021 (G.R. No. 421 of 2021) lodged under Sections 272 and 273 of the I.P.C. read with Section 30(a) of the Bihar Prohibition and Excise Act- 2016. Learned counsel for the petitioner submits that vide order dated 17.05.2022, provisional bail was granted to the petitioner in which 4 conditions were there. Learned counsel for the petitioner submits that he is complying all such conditions. Learned Standing Counsel 11 submits that vide order dated 24.06.2022, 12 weeks time was granted to the State to ensure the compliance of the order. He submits that the said order has been complied and report has been submitted which is Memo. No. 1285 dated 15.05.2022.

In the present facts and circumstances of the case mentioned above, the bail petition of the petitioner is hereby confirmed. The report submitted by the State is accepted and this case is disposed off."

4. The above order be treated to have been passed in

Patna High Court CR. MISC. No.43557 of 2021(14) dt.22-02-2024 3/3 the present case on 26.09.2023.

5. Accordingly, the order dated 26.09.2022 passed in Cr. Misc. No.42557 of 2021 is directed to be offloaded from the website of Patna High Court.
