JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-420, 467, 468, 414/34 of the Indian Penal Code. One stolen motorcycle is said to have been recovered from possession of the petitioner and two other co-accused persons and the petitioner as well as co-accused disclosed the informant that they had stolen the aforesaid motorcycle from Madhubani court.
From perusal of the case diary, I find that for the theft of the aforesaid motorcycle, Madhubani Town P.S. Case No. 365 of 2015 was registered. The petitioner carries criminal antecedent of several cases and, therefore, I am not inclined to release the
Patna High Court Cr.Misc. No.5420 of 2016 (4) dt.11-03-2016 2/2 petitioner on bail and accordingly, his prayer for bail in connection with Bahadurpur P.S. Case No. 326 of 2015 pending in the court of learned Chief Judicial Magistrate, Darbhanga stands rejected. However, the petitioner may renew his prayer for bail after six months, if his trial is not concluded within the above-said period.
