JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, name of the petitioner came in this case on the basis of information, furnished by spy of the police and thereafter, petitioner and some others were arrested and firearms were recovered from their possession. It appears that except the aforesaid material, there is nothing against the petitioner. So far as statement of witness, Baby Kumari is concerned; having more or less similar allegation, one co-accused namely, Pankaj Yadav @ Prakash Yadav @ Sanjeet Bharati has already been granted privilege of bail by a coordinate bench of this court.

No.5286 of 2016 (2) dt.15-02-2016 2/2 Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jhajha P.S. Case No. 85 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Jamui.
