JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2015 Petitioner is languishing in custody since 15.06.2014 in a case registered for the offences punishable under Section 395 of the I.P.C.

A vehicle loaded with chicken was hijacked.

Subsequently the vehicle and the chicken were recovered from the poultry firm of Sonu Singh. The petitioner was also present there and from his possession Samsung mobile was recovered. Though it appears from the impugned order that petitioner was identified by the driver and the cleaner of the vehicle. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of recovery, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case

Let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
