2. The accused/petitioner seeks bail in connection with G.R. No.1308 of 2024 arising out of Pupri P.S. Case No.496 of 2024 registered for the offences punishable under Sections 309(4) and 311 of the Bhartiya Nyaya Sanhita, 2023 (for short 'B.N.S.').

3. The accused/petitioner is not named in the FIR and is in custody since 13.02.2025.

4. Allegation against the petitioner is to commit robbery and while committing so, looted cash of Rs.3,89,613/- along with two mobile phones. It is also alleged by informant that one Nitish Kumar, who was his Ex-staff was

2/4 dismissed from service as he found consuming liquor with one Vikash Kumar, who together hatched a conspiracy with other unknown accused person, leading to arrest of co-accused Lakshimeshwar Singh.

5. It is submitted by learned counsel that petitioner was remanded in this matter from Runnisaidpur P.S. Case No.4 of 2025 on the basis of his self-confession, in furtherance of which, no incriminating material appears recovered/surfaced during course of investigation as to connect the petitioner with present robbery. It is pointed out that the reason for implication of the petitioner is his criminal antecedent, as he found involved in seven more criminal cases, where he is on bail and in maximum of these cases, the name of petitioner transpired either on the basis of selfconfession or on confessional statement of co-accused, having otherwise no evidentiary value under the law. The petitioner has not put on T.I.P. as yet. It is pointed out that similarly situated co-accused, namely, Mukesh Kumar @ Mukesh Kumar Singh was granted anticipatory bail by one of the learned co-ordinate Bench of this Court through Cr. Misc.

3/4 No.40972 of 2025 dated 09.07.2025. While concluding argument, it is submitted that investigation of this case is already completed, for which, charge-sheet has been submitted and, as such, there is no chance of tampering with the evidence.

6. Learned APP opposes the prayer for grant of bail to the petitioner.

In view of aforesaid factual submissions and by taking note of fact as except suspicion arising out of selfconfession, nothing prima facie appears incriminating against the petitioner as to connect him with present crime in question, coupled with the fact that investigation of this case is already completed, where petitioner remains in custody since 13.02.2025, accordingly, the petitioner, above-named, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Subdivisional Judicial Magistrate, Pupri at Sitamarhi in connection with G.R. No.1308 of 2024 arising out of Pupri P.S. Case No.496 of 2024 subject to the conditions as laid down under

4/4 Section 437(3) of the Code of Criminal Procedure (for short 'CrPC')/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS').
