2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

3. The petitioners seek bail in connection with Jharakhar P.S. Case No. 18 of 2026 registered for the offences punishable under Sections 317(4) and 317(5) read with Section 3(5) of the B.N.S., 2023.

4. As per prosecution case, during the course of vehicle checking a Splendor motorcycle was stopped for checking and it was found that the same is registered in the name of one Shriram Kumar and is flagged not to be transacted (NTBT) by Motihari, Bihar due to theft.

5. Learned counsel for the petitioners submits that petitioners are innocent and they have falsely been implicated in the present case. Nothing incriminating has been recovered from conscious possession of the petitioners. Learned counsel further submits that one Rohit Kumar was arrested with the motorcycle in question and they were just standing at the place of vehicle checking. Learned counsel lastly submits that petitioners have clean antecedent and they are in custody since 03.02.2026.

6. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioners.

7. Considering the aforesaid facts and circumstances of the case and also considering the fact that petitioners have clean antecedent, nothing has been recovered from their conscious possession and further considering their period of custody, this Court is inclined to grant bail to the petitioners.

8. Accordingly, let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the learned S.D.M., Dhaka at Motihari, in connection with Jharakhar P.S. Case No. 18 of

9. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observation shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
