The petitioner being the Headmaster of Primary School, Maharani Bhopat is languishing in custody since 22.03.2014 in a case registered for the offences punishable under Sections 409, 420 and 188 of the Indian Penal Code. It is alleged that the petitioner used not to sub-standard material in construction of the school building but also made construction much below the specifications. It is submitted by learned counsel for the petitioner that the construction work has not still been completed and mechanically the FIR has been lodged against the petitioner.
