Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of I.P.C. and 25 (1B)a, 26 and 35 Arms Act. The police got information that some criminals who have recently been released on bail are likely to commit offence on rape. Petitioner and two others were apprehended. From possession of the petitioner, a pistol and two live cartridges were recovered.

Learned counsel for the petitioner submits that petitioner is in custody since 31.05.2020. Investigation of the case is already complete. The criminal cases, referred in para-3 of the petition are due to land dispute, lodged by the cousin of the petitioner.

Considering the nature of allegation, period already

No.32536 of 2020(3) dt.05-02-2021 2/2 undergone by the petitioner and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gwalpara (Arar O.P.) Police Station Case No.67 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
