Petitioner seeks bail in Agamkuan P.S. Case No.256 of 2019 instituted for the offence under Section(s) 30(a) (b), 37(c), 38, 41 of Bihar Prohibition and Excise Act, 2016. It is alleged that four persons on seeing the police party fled away after throwing the bags, which they were carrying. As per seizure list, 10 litres Mahua liquor has been recovered from the bag, which was allegedly carried by this petitioner.

Seizure list is part of the First Information Report, which does not bear signature of the petitioner. Counsel for the petitioner submits that Petitioner is in custody since 15.03.2019 having clean antecedents.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Agamkuan P.S. Case No.256 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
