The petitioner seeks bail in a case under Sections 489(A), 489(B), 489(C)/34 of the Indian Penal Code. The police officer of Special Task Force got information that a person was carrying huge quantity of fake currency notes on a train and, on such, the police team searched the train but again the raiding party received information that the person was near Buddha Park and, on such, the petitioner was apprehended and from his possession, 850 notes, each of 1000 denomination, were recovered. It is submitted that the petitioner was not found circulating fake currency notes and, therefore, no offence under Sections 489(A) & 489(B) is made out. At best, offence under Section 489(C) can be made out.
Patna High Court Cr.Misc. No.45235 of 2014 (4) dt.10-04-2015 2/2 There appears that huge quantity of fake currency notes, each of 1000 denomination, was recovered from the possession of the petitioner while the petitioner was moving around for distribution of the same.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. The same is rejected. The trial court is directed to expedite the trial and conclude the same within one year from the date of receipt of this order.
