The petitioner seeks bail in connection with Tajpur P.S. Case No. 378 of 2014 registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code. The informant stated that Rohit Kumar Rai and the petitioner were in the Auto Rickshaw and they agreed to take sister-in-law of the informant to her destination. The brother of the informant was also persuaded to sit in the Auto Rickshaw but the brother of the informant did not return. The petitioner is said to have informed the informant about the dead body of his brother. The informant suspected that the said Rohit Kumar Rai killed his brother by assaulting him with iron rod.
It appears from the order of the learned Sessions Judge
Patna High Court Cr.Misc. No.14107 of 2015 (2) dt.24-04-2015 that during course of investigation, witnesses of the vicinity disclosed that the auto rickshaw fell down in a ditch and one person was found badly injured and his dead body was throne in the ditch by the driver of the Tempo, in question. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Judicial Magistrate 1st Class-cum-A.M.2, Civil Court, Samastipur in connection with Tajpur P.S. Case No. 378 of 2014.
